Terms of Service

1. The Service

HX OS is a strategic intelligence SaaS platform that provides AI-powered brand emotional architecture analysis, competitive simulation, and strategic recommendations. The Service is provided via subscription and accessed through coracodex.xyz.

2. Eligibility

You must be at least 18 years of age and have the legal authority to enter into binding contracts. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Accounts

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete registration information.
• You must notify us immediately at support@coracodex.xyz of any unauthorized access to your account.
• One account per individual user. Sharing credentials between multiple users is prohibited.

4. Subscription and Payment

• The Service is offered on a subscription basis with plans as described on the Pricing page.
• Subscriptions renew automatically unless canceled before the renewal date.
• Payments are processed by Stripe. By subscribing, you also agree to Stripe's terms of service.
• Prices may change with 30 days' advance notice to your registered email.
• All payments are in USD unless otherwise specified at checkout.
• Taxes may apply depending on your jurisdiction and will be shown at checkout.

5. Free Trial and Refund Policy

New subscribers receive a 14-day money-back guarantee. If you are not satisfied within the first 14 days of your first paid subscription, contact support@coracodex.xyz for a full refund. After 14 days, all payments are final and non-refundable except where required by applicable law.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation
• Attempt to reverse-engineer, decompile, or extract source code from any part of the Service
• Use automated bots, scrapers, or scripts to access or extract data from the Service
• Attempt to gain unauthorized access to any systems or data
• Transmit malicious code, viruses, or disruptive data
• Use the Service to generate or disseminate false, misleading, or harmful content
• Resell or sublicense access to the Service without written authorization from the Company

7. Intellectual Property

The Service, including the CORA AI engine, HX OS framework, 15-dimensional emotional driver methodology, software, interface designs, and all related content, is owned by the Company and protected by Brazilian and international intellectual property law.

You retain ownership of the strategic input data you provide. By submitting data to the Service, you grant us a limited license to process that data to deliver the Service and improve our AI models (using only anonymized, aggregated data for the latter).

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Service Availability and Modifications

We strive for 99.5% monthly uptime. We may modify, suspend, or discontinue any part of the Service with reasonable notice. We are not liable for temporary interruptions due to maintenance, security incidents, or circumstances beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Company and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (i) the amount you paid us in the 12 months preceding the claim or (ii) USD 100.

11. Warranty Disclaimer

The Service is provided "as is" without warranties of any kind, whether express or implied. We do not warrant that the Service will be error-free, uninterrupted, or that AI-generated analyses will be accurate or suitable for any particular business decision. You are solely responsible for how you use strategic intelligence outputs.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federative Republic of Brazil. The parties submit to the exclusive jurisdiction of the courts of the city of São Paulo, State of São Paulo, Brazil, for resolution of any disputes arising from these Terms.

For users in the European Union, nothing in these Terms affects your statutory consumer rights under applicable EU law.

13. Termination

You may terminate your account at any time by canceling your subscription in account settings. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to access the Service ceases and we will process your data as described in the Privacy Policy.

14. Changes to Terms

We may update these Terms. Material changes will be communicated via email at least 15 days in advance. Continued use after the effective date of changes constitutes acceptance. If you do not agree to updated Terms, you may terminate your account before they take effect.
